What is a Homestead Declaration?

  • Coverage: Only applies to a person's primary residence, not investment or rental properties.

  • Limits: Each state sets a dollar limit for how much of the home’s equity is protected. In Nevada, as of the most recent update, the protection limit is $605,000 of equity.

  • Filing: Must be filed with the county recorder’s office where the property is located.

  • Cost: Usually a small recording fee is required.

  • Ownership Requirement: Must be the owner or a co-owner of the home and live in it as your primary residence.

  • Marital Considerations: In some cases, spouses may need to sign together even if only one name is on the title.
